The rules that govern access to FlyMeOut's watch automation, travel intelligence dashboards, beta experiments, and related services.

These Terms of Service (the "Terms") form a binding agreement between you and FlyMeOut, Inc. when you create an account, join the waitlist, or otherwise use our sites, dashboards, or APIs. If you are acting on behalf of a company, you confirm that you have authority to bind that entity. If you do not agree, do not access the service.
We may update these Terms to align with new features or legal requirements. We will post changes here and, for material updates, notify you through the product or email at least 14 days before they take effect unless immediate changes are required.
2. Service description & relationship with travel providers
FlyMeOut is a fare intelligence and monitoring tool. We surface prices, trend data, and alerts by querying third-party sources such as Amadeus and airline partners, but we do not sell tickets, issue confirmations, or collect passenger payments.
Any booking you complete after seeing an alert is handled directly with the airline, OTA, or travel provider. Their terms, privacy notices, and refund policies govern that transaction. Prices and availability can change at any time; FlyMeOut cannot guarantee fares displayed in the product.
3. Eligibility & account responsibilities
You must be at least 16 and capable of forming a legally binding contract. Accounts are provisioned through Clerk; you agree not to share credentials, circumvent security controls, or impersonate another person.
You are responsible for every watch, alert, support ticket, or message submitted through your account. Keep your contact information current so we can deliver notices about watches, billing, or legal updates.
4. Watches, alerts, and accuracy
We strive to match or exceed the service levels provided by other travel meta-search leaders, but flight and hotel data changes rapidly. You acknowledge that:
- Watches are best-effort automations. Delays, rate limits, outages from upstream APIs, or airline schedule changes may impact alert cadence.
- Price snapshots represent the fares we received at the time of polling; airlines and OTAs may change prices before you book.
- Currency conversions, baggage inclusions, or fare class notes are derived data and may not reflect every nuance of a specific airline ticket.
- Alert delivery channels (email, push, webhook) rely on third parties; we are not liable for delays or failures outside our infrastructure.
5. Beta programs, feedback, and experiments
Some features (hotel insights, alternative airport suggestions, revenue dashboards) are experimental. By opting in you understand that data may be sampled, rate-limited, or subject to additional usage caps.
We welcome feedback, feature ideas, or bug reports. By submitting feedback you grant FlyMeOut a perpetual, royalty-free license to use it in any product without restriction.
6. Subscriptions, billing, and refunds
During private beta, FlyMeOut is free. Future paid tiers may include premium alert speeds, additional watches, or enterprise analytics. If you choose a paid plan:
- Fees, billing frequency, and included quotas will be presented at checkout or in an order form.
- Unless stated otherwise, subscriptions renew automatically until cancelled. You can downgrade or cancel in the account portal and retain access through the end of the billing period.
- We may suspend or terminate access for unpaid invoices. Except where required by law, fees are non-refundable once the billing period has started.
- Taxes, exchange fees, or bank charges are your responsibility.
7. Acceptable use
You agree not to misuse the service. Examples of prohibited activity include:
- Reverse engineering, copying, scraping, or bulk exporting data except through documented APIs with written permission.
- Automating account creation, manipulating waitlist rankings, or probing for vulnerabilities without authorization.
- Using the product to support unlawful discrimination, sanctions violations, fraud, or any activity that infringes on another party's rights.
- Attempting to resell alerts or white-label FlyMeOut without a commercial agreement.
8. Third-party links & integrations
The platform integrates with services such as Clerk (identity), Supabase/PostgreSQL (data layer via our backend), and communication tools. Their terms govern how they operate. Links to external booking sites, airline portals, or partner dashboards are provided for convenience; FlyMeOut is not responsible for their content or policies.
9. Privacy
Our Privacy Policy describes how we collect and use personal data. By using FlyMeOut you consent to those practices. If these Terms conflict with the Privacy Policy, these Terms control only to the extent of the conflict. Review the full policy at any time:

10. Intellectual property
FlyMeOut, along with its dashboards, logos, design system, and proprietary datasets, are owned by FlyMeOut, Inc. or our licensors. Except for the limited right to access the service while you comply with these Terms, no other licenses are granted. Do not remove trademarks, copyright notices, or attribution lines from any view or export.
11. Suspension and termination
We may suspend or terminate access immediately if you breach these Terms, fail to pay fees, or pose a security risk. You may close your account at any time; sections that by their nature should survive (including intellectual property, indemnity, disclaimers, and limitations of liability) remain in effect.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES-EXPRESS OR IMPLIED-INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. DATA MAY CONTAIN ERRORS OR BECOME OUT OF DATE BEFORE YOU ACT ON IT.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FLYMEOUT AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, NOR FOR LOST PROFITS, LOST BOOKINGS, OR LOSS OF GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID TO FLYMEOUT FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES THE LIMITATION APPLIES TO THE MAXIMUM EXTENT PERMITTED.
14. Indemnification
You agree to defend, indemnify, and hold harmless FlyMeOut from losses, liabilities, claims, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these Terms, or your infringement of any rights of another party.
15. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to conflicts of law principles. The parties agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California for any disputes that are not subject to arbitration or informal resolution.
Before filing suit, each party agrees to try in good faith to resolve disputes informally by emailing legal@flymeout.com and allowing 30 days for a response. We may offer arbitration or other resolution options where required by law.
16. Changes to the service or terms
We may modify, discontinue, or sunset features (including beta experiments) at any time. Where changes materially reduce core functionality, we will give advance notice and provide options to export your data.
We may update these Terms as described in Section 1. Continued use after updates take effect constitutes acceptance.
